At CCSD 46, we want to reassure our families that our schools are safe, welcoming spaces for every child. Please know that all children—regardless of immigration status—have the right to a public education, and our district is committed to protecting their access to learning. We do not collect or share information about immigration status, and student records are strictly protected by law. If immigration officials ever request access to a student, our administrators will follow all legal requirements to safeguard the rights and privacy of our students and families.
Most importantly, we want our immigrant families to feel cared for and supported. You are a vital part of our community, and we will continue to stand by you with compassion, respect, and resources to ensure your children’s success and well-being.
In the United States, all children are entitled to equal access to a basic public elementary and secondary education, regardless of their actual or perceived immigration status, or the status of their parents/guardians. This standard has been upheld by the U.S. Supreme Court in Plyler v. Doe, even in instances where a student may be undocumented. It is essential to note that a student’s attendance at school does not constitute a violation of the law, regardless of their immigration status. Additionally, schools are not permitted to track a student’s or parent’s citizenship status or inquire about such status. Student records remain protected by the Family Educational Rights and Privacy Act (FERPA). In compliance with state and federal law, CCSD 46 will continue to prioritize individual student rights and privacy if a law enforcement official requests to interview students at school.
